WILL I LOSE MY HOME?

Probably not; it depends on how much your house is worth, the balance on your mortgage and how far behind you are.  In fact if you are behind on your mortgage payments, a Chapter 13 plan can prevent foreclosure and help you keep your home.

WILL I LOSE MY BELONGINGS?

Probably not, very few debtors have their personal belongings sold because of state law exemptions and protections.

DO I HAVE TO LIST ALL MY DEBTS?

Yes, the law requires that you list all of your debts. It would not be fair to your creditors to leave one off.

SHOULD BANKRUPTCY BE MY LAST RESORT?

No. Bankruptcy is a financial tool to help you get a fresh start. If you can’t pay off all of your debt in the next 3 years, except your mortgage, while maintaining a minimally comfortable standard of living, you should, at least, consider bankruptcy.

CAN BANKRUPTCY ERASE ALL DEBTS?

Bankruptcy cannot erase some debts like alimony, child support,  most student loans and some taxes.
